How we collect, protect, and respect your personal information — including our HIPAA Notice of Privacy Practices.

This page contains two notices: our Website Privacy Policy (Sections 1–13), which covers information collected through this website, and our HIPAA Notice of Privacy Practices (below), which covers protected health information you share with us as a patient. Where the two differ regarding health information, the Notice of Privacy Practices controls.

Privacy is a fundamental right. This Privacy Notice explains how Aiken Medical Aesthetics, LLC handles the Personal Information of visitors to this website, the legal basis on which we process it, and the rights available to you under privacy laws around the world. Please read it so you understand our use of your Personal Information, our obligations to you, and your privacy rights.

Aiken Medical Aesthetics does not share customer opt-in information, including phone numbers and consent records, with any affiliates or third parties for marketing, promotional, or any other purposes unrelated to providing our direct services. All text messaging originator opt-in data is kept strictly confidential.

1. Consent

Except as required or permitted by applicable data protection laws, we will not collect, use, or disclose your Personal Information for any purpose for which you refuse or later withdraw consent. You may withdraw your consent at any time with future effect. If you withdraw consent, we may continue to use previously provided information to the extent we are contractually obligated, to enforce contractual obligations, or for other legitimate purposes (including fraud prevention) permitted by law — though we may no longer be able to communicate with you or provide requested services.

2. What Is Personal Information?

"Personal Information" is any information that identifies, relates to, describes, or could reasonably be linked with a particular individual. The types we collect include:

  • Contact & payment details — name, email address, phone number, physical address, payment information, and opt-in records and timestamps for all communication channels
  • Customer communication — records of inquiries, appointment details and preferences, service history and feedback
  • Non-personal information — IP address, browser and device information, website usage patterns, analytics, and cookies
  • Professional information — for employment candidates, job history or performance evaluations

3. Your Privacy Rights

No matter where you live, you have the following rights regarding the Personal Information we collect, use, or share: the right to be informed; to access a copy of your Personal Information (including the categories collected, sources, and purposes); to rectification of inaccurate or incomplete data; to deletion ("right to be forgotten"); to restriction of processing; to data portability in a structured, machine-readable format; to object to processing; to no discrimination for exercising your rights; to appeal decisions; to opt out of automated decision-making, targeted advertising, and the sale of data; and to lodge a complaint with your supervisory authority.

We will honor valid, verified requests within 30 days, free of charge, though we may decline requests where disclosure would reveal another person's information, is subject to legal privilege, or is otherwise restricted by law.

4. Why We Collect Personal Information

We only collect the Personal Information we need, and use it only as set out in this notice: to respond to you after an inquiry, comment, or job application; to provide you with services you have requested; and for advertising of our services.

5. Marketing, Cookies & Site Usage

If you submit a contact request or employment application, you consent to receive electronic promotional materials, which you may opt out of at any time. Like most websites, we gather aggregated traffic and usage data that does not identify you individually. We currently do not respond to Do Not Track signals.

6. SMS Messaging & Data Protection

SMS opt-in is optional and can be stopped at any time by replying "STOP"; opt-out requests are processed immediately, and you may reply "HELP" for assistance. Message frequency varies with your interactions, messages relate directly to services you have requested, and standard message and data rates may apply. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Sharing with subcontractors in support services, such as customer service, is permitted; all other categories exclude text messaging originator opt-in data and consent.

7. Data Controller & Legal Basis

Aiken Medical Aesthetics, LLC is the data controller for the processing described here. We process your Personal Information as necessary to perform our contract with you, to comply with legal obligations, and for our legitimate interests in the efficient management of our business relationship with you.

8. How We Share Your Information

We do not sell, rent, or trade personal information. We may share information with service providers who assist our operations (such as payment processing and appointment scheduling) under contractual confidentiality obligations; when required by law, legal process, or valid law enforcement requests; and in connection with business transfers such as mergers or acquisitions, where your data remains protected under this policy.

9. How We Protect Your Information

We use appropriate physical, technical, and organizational security measures — including encryption in transit and at rest, secure access controls, regular security assessments, employee training, breach notification protocols, and secure backups. No method of transmission or storage is 100% secure, but we strive to use commercially acceptable means to protect your information.

10. Data Retention

We retain Personal Information only as long as necessary for the purposes for which it was collected, to comply with legal obligations, or until you request deletion. Upon a verified deletion request, we will delete your information from our records (and direct our service providers to do the same), except where retention is required to complete a requested service, detect security incidents, comply with legal obligations, or support lawful internal uses.

We reserve the right to modify this Privacy Notice at any time, subject to applicable data protection laws. Please visit this page periodically for the latest version.

12. Analytics, Advertising Cookies & Opt-Out

This website uses Google Analytics and Google Ads conversion and remarketing tags (loaded through Google Tag Manager), and a call-tracking service that assigns a tracking phone number to visitors so we can measure which advertising brings people to us. These tools use cookies and similar identifiers to measure traffic, understand how the site is used, and show you our ads on Google and partner sites after you visit. These tools do not receive information from your medical record, and we do not use health information to target advertising. You can opt out of personalized advertising from Google at adssettings.google.com, opt out of Google Analytics with the Google Analytics opt-out browser add-on, and opt out of interest-based advertising generally at optout.networkadvertising.org. You can also block or delete cookies in your browser settings. Google's use of data is described at policies.google.com/technologies/partner-sites.

13. Online Booking & Consultation Requests

Online booking on this website is provided by Boulevard, our practice management and scheduling platform, and consultation requests submitted through this website are delivered to our patient communication system so our team can respond to you. Both are transmitted over an encrypted (HTTPS) connection. Service providers that handle patient information do so under a HIPAA business associate agreement. Information you provide when booking or requesting a consultation about a treatment becomes part of your patient record and is protected as described in our Notice of Privacy Practices below.

Notice of Privacy Practices (HIPAA)

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Our Legal Responsibilities

We are required by law to give you this notice. It explains how we may use and disclose protected health information about you and describes your rights and our obligations regarding the use and disclosure of that information. We are required to maintain the privacy of your protected health information, to provide you with notice of our legal duties and privacy practices with respect to that information, to notify you following a breach of your unsecured protected health information, and to follow the terms of the notice currently in effect.

We reserve the right to change the terms of this notice at any time. If we change our privacy practices, the revised notice will apply to all protected health information we maintain, including information created or received before the change. The current notice is posted in our office and on our website, and a copy is available at any time by request. How We May Use or Disclose Your Protected Health Information

The following examples describe ways that we may use your protected health information for your treatment, payment, and health care operations. Please be advised that not every use or disclosure in a particular category will be listed.

Treatment: We may use and disclose your protected health information to provide you treatment. This includes disclosing your protected health information to other medical providers, trainees, therapists, medical staff, and office staff that are involved in your health care. For example, your medical provider might need to consult with another provider to coordinate your care. Also, the office staff may need to use and disclose your protected health information to other individuals outside of our office, such as the pharmacy when a prescription is called in.

Payment: Your protected health information may also be used and disclosed to obtain payment for the services we provide to you.

Health Care Operations: We may use or disclose your protected health information to operate this medical practice. These activities include training students, reviewing cases with employees, utilizing your information to improve the quality of care, and contacting you by telephone, email, or text to remind you of your appointments. If we have to share your protected health information with third-party “business associates,” such as our scheduling, records, or billing software providers, we will have a written contract that contains terms that will protect the privacy of your protected health information.

Appointment Reminders: We may contact you as a reminder that you have an appointment for your initial visit, follow-up visit, or lab work via text, phone, or email.

Others Involved in Your Health Care: We may disclose protected health information about you to your family members or friends if we obtain your verbal agreement to do so, or if we give you an opportunity to object to such a disclosure and you do not raise an objection. For example, we may assume that if your spouse or friend is present during your evaluation, we can disclose protected health information to this person. If you are unable to agree or object to such a disclosure, we may disclose such information as necessary if we determine that it is in your best interest based on our professional judgment if there is an urgent or emergent need.

Research: We will not use or disclose your health information for research purposes unless you give us authorization to do so.

Organ Donation: If you are an organ donor, we may release protected health information to organizations that handle organ procurement or organ, eye, or tissue transplantation if it is necessary to facilitate this process.

Public Health Risks: We may disclose your protected health information, if necessary, in order to prevent or control disease, report adverse events from medications or products, or prevent injury, disability, or death. This information may be disclosed to healthcare systems, government agencies, or public health authorities. We may have to disclose your protected health information to the Food and Drug Administration to report adverse events, defects, or problems, or to enable recalls, if required by FDA regulation.

Health Oversight Activities: We may disclose protected health information to health oversight agencies for audits, investigations, inspections, or licensing purposes. These disclosures might be necessary for state and federal agencies to monitor healthcare systems and compliance with civil law.

Required by Law: We will disclose protected health information about you when required to do so by federal, state, and/or local law.

Workers’ Compensation: We may disclose your protected health information to workers’ compensation or similar programs.

Lawsuits: We may disclose your protected health information in response to a court action, administrative action, or a subpoena.

Law Enforcement: We may release protected health information to a law enforcement official in response to a court order, subpoena, or warrant, subject to all applicable legal requirements.

Uses and Disclosures That Require Your Written Authorization

We will not use or disclose your protected health information for any purpose other than those identified in this notice without your specific, written authorization. In particular, the following uses and disclosures will be made only with your written authorization: most uses and disclosures for marketing purposes; any sale of your protected health information; and the use of your photographs or treatment images for marketing, social media, or educational purposes. Face-to-face communications about products or services and promotional gifts of nominal value do not require an authorization. Without your authorization, we may still send you information about our own services and appointment-related communications as part of your care.

You may give us written authorization to use your protected health information or to disclose it to anyone for any purpose. You may revoke an authorization at any time in writing, except to the extent that we have already acted in reliance on it.

Your Rights Regarding Your Protected Health Information

Access to Medical Records: You have the right to access, inspect, and receive copies of your protected health information that we use to make decisions about your care. Submit a written request to the contact listed at the end of this notice. We may charge a reasonable, cost-based fee for copying and mailing your records.

Amendment: If you believe the protected health information we have about you is incorrect or incomplete, you may ask us to amend the information. You will need to submit a written request explaining why you feel the health information should be amended. We may deny your request if you do not send a written request or give a reason why it should be amended, or if we believe the protected health information is accurate and complete. If we deny your request, we will provide you a written explanation.

Accounting of Disclosures: You have the right to receive a list of instances in which we disclosed your protected health information, other than disclosures made for treatment, payment, or health care operations, disclosures made pursuant to a valid authorization, and disclosures otherwise permitted by applicable federal and state law. Submit a written request to the contact listed at the end of this notice. The accounting will include the dates of the disclosures, the names of the individuals or entities we disclosed the information to, a description of the information disclosed, and the reason for the disclosure. The accounting may cover up to six years prior to the date of your request. The first accounting in a 12-month period is free; we may charge a reasonable fee for additional requests.

Restriction Requests: You have the right to request a restriction or limitation on the protected health information we use or disclose about you for treatment, payment, or health care operations. We are not required to agree to every request, except where the disclosure is required by law. Requests must be submitted in writing to the contact listed at the end of this notice. If you pay for a service in full out of pocket, you have the right to request that we not disclose information about that service to your health plan for payment or operations purposes, and we must honor that request unless the disclosure is required by law.

Confidential Communication: You have the right to request that we communicate with you about healthcare matters in a certain way or at a certain location (for example, only by email, or only at a specific phone number). We will accommodate reasonable requests.

Notification of a Breach: You have the right to be notified if there is a breach of your unsecured protected health information.

Paper Copy of This Notice: You have the right to a paper copy of this notice at any time, even if you reviewed or signed it electronically. To obtain a copy, contact the individual listed at the end of this notice.

Complaints

If you believe your privacy rights have been violated, you may file a complaint with our office using the contact information below. You may also file a complaint with the Secretary of the U.S. Department of Health and Human Services, Office for Civil Rights, at 200 Independence Avenue SW, Washington, DC 20201, by calling 1-800-368-1019, or online at www.hhs.gov/ocr/complaints. We will not retaliate against you for filing a complaint.
